Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the World Padel Rating mobile application and the player-facing website at worldpadelrating.com (together, the “Player App”), operated by UP PADEL CORP, a Delaware corporation with its principal place of business in Southampton, New York, doing business as World Padel Rating (“World Padel Rating,” “WPR,” “we,” “us,” or “our”).

By creating an account or using the Player App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Player App.

WPR Manager, our separate portal for club directors and tournament organizers, is governed by its own terms, not by these Terms.

We may translate these Terms into other languages for your convenience. The English version governs, and any inconsistency between versions is resolved in favor of the English version.

1. Eligibility and Accounts

1.1 Age Requirements

You must be at least 13 years of age to create an account. Where a higher age of digital consent applies, that higher age applies, including 14 in Quebec, Canada. A user below the applicable age may use the Player App only through a Minor Account created with verifiable parental consent, as described in Section 2.

1.2 Account Responsibilities

When you create an account, you agree to:

• Provide true, accurate, and complete information, and keep it current.
• Keep your password and PIN confidential.
• Notify us promptly at support@worldpadelrating.com of any unauthorized use of your account.
• Maintain only one account per person, as described in Section 1.3.

You are responsible for all activity that occurs under your account.

1.3 One Account per Player; Duplicate and Recreated Accounts

Each player may hold only one account on the Player App. Your ratings, confidence level, and match history belong to you as a player, not to any particular account. You may not create a duplicate or additional account, and you may not delete, abandon, or deactivate an account and then create a new one, to reset, conceal, alter, or otherwise manipulate your rating, confidence level, match history, division eligibility, or any other part of your competitive record.

If we determine, acting reasonably and on the basis of identity, registration, contact, device, payment, or match data, that you hold duplicate accounts or have created a new account after deleting or abandoning a previous one, we may: link or merge the accounts; apply your previous match history, ratings, and confidence level to the new or surviving account; recalculate your ratings, confidence level, and event or division eligibility; reverse, adjust, or disqualify results, standings, placements, or prizes obtained while competing under a rating that did not reflect your carried-over record; and suspend or terminate any or all of the accounts involved. We will give you notice where practicable.

Deleting an account does not erase your competitive record for rating-integrity purposes. We retain your email address and telephone number for up to 30 days after deletion, as described in our Privacy Policy, so that we can detect re-registration within that period and re-apply your match history and rating to a new account. A request to delete your account for the purpose of keeping a duplicate that circumvents the rating system is not a valid exercise of a deletion right and may be denied. Circumventing or attempting to circumvent this Section is a material breach of these Terms and may result in permanent removal from the Player App.

If you have inadvertently created more than one account, for example because you lost access to your original credentials, contact support@worldpadelrating.com and we will merge your accounts and preserve your match history.

2. Minor Accounts and Parental Consent

2.1 Parental Consent Process

To create an account for a user below the applicable age threshold:

• A parent or legal guardian must have an active WPR account.
• The parent or guardian submits a child-registration request through the Player App.
• The parent or guardian reviews and accepts these Terms and our Privacy Policy on behalf of the minor.
• The parent or guardian completes our electronic parental consent form through our signature partner, SignNow.
• We review the signed consent and create the Minor Account.

The parental consent form governs the consent given for a Minor Account and forms part of the agreement between you and us for that account. Minor Accounts cannot be created through our public programming interface or by a third-party application.

2.2 Parental Responsibilities

The parent or legal guardian who provides consent is responsible for the minor’s use of the Player App and may, by contacting support@worldpadelrating.com, review the minor’s account information, request correction or deletion of the minor’s personal information, and withdraw consent at any time.

2.3 Withdrawal of Parental Consent

A parent or legal guardian may withdraw consent at any time by contacting support@worldpadelrating.com. On withdrawal, we deactivate the Minor Account within 10 business days and de-identify the minor’s personal information within 30 days, as described in our Privacy Policy. We may keep de-identified match data to preserve other players’ records and the rating system. A new consent process is required to create a new Minor Account.

3. The Rating System

3.1 How Ratings Work

The Player App operates a rating and ranking system for padel players. By using the Player App, you agree to take part in this system. Your ratings are calculated automatically from your match results and are displayed publicly on leaderboards, subject to the confidence rules in Section 3.3. We do not guarantee that any rating is error-free.

3.2 Two Ratings: WPR and WPR-s

The Player App maintains two distinct ratings for each player:

WPR (Competitive Rating): your verified competitive rating, built from matches played under WPR Verified Rules. Only matches that follow WPR Verified Rules count toward your WPR. Tournaments, including USA Padel and PAC-sanctioned events and certain WPR-powered events, and official leagues may count toward your WPR.

WPR-s (Social Rating): your general or social rating, built from social and unofficial match results, including results submitted through the “Post a Score” feature. Practice matches, exhibitions, and other unofficial matches count toward your WPR-s only.

Each match is classified as social or competitive and affects only the corresponding rating. The two ratings are otherwise independent, except that when a club, coach, or event organizer sets your initial placement, they may set both ratings at the same time, after which each evolves separately.

3.3 Rating Confidence

Every rating carries a confidence level, which reflects how certain the system is that the rating represents your current level. A new player who completes the initial survey holds No Confidence (NC) status until enough qualifying matches have been played within a qualifying time frame. A player reaching 5% confidence attains Low Confidence (LC) status, at which point the rating becomes publicly visible. A player above 35% confidence attains high-confidence status, shown by a checkmark on the profile. Confidence declines with inactivity, and a player may fall back to NC status. Confidence levels, confidence decay, and the associated visibility rules are features of the rating system and may be modified by us from time to time.

3.4 How Ratings Move

Ratings are driven by actual results measured against expected outcomes. For each match, the rating method determines an expected result based primarily on the rating and confidence level of each player on the court, together with other variables. As a result, your rating may decrease after a match you won if you underperformed the expected outcome, your rating may increase after a match you lost if you overperformed it, and each recorded result generally increases your rating confidence. Rating movements produced by the ordinary operation of the rating method are not errors.

3.5 Initial Ratings and Self-Assessment

New players complete an initial survey and select a primary club, from which an initial rating is generated. Initial self-assessed ratings are capped at levels we publish and may update from time to time. Ratings above the applicable cap must be earned through validated play, review by a coach, club, or event organizer, or a verified FIP World Ranking conversion under the conversion tables we publish. Your primary club or an event organizer may assign an initial rating that gives your confidence an initial boost. We may also make automated tools, including AI-assisted tools, available to establish initial ratings; the “Automated Calculation of Your Rating” section of our Privacy Policy describes how automated rating tools work and the choices available to you.

Rating assignments are part of the core functionality of the Player App and do not require separate consent beyond your acceptance of these Terms. You represent that any self-assessment you provide is honest and made in good faith. Deliberately misrepresenting your level in a self-assessment, whether by understating or inflating it, is a violation of these Terms.

3.6 Rating Adjustments by Clubs and Event Organizers

The integrity of level-based play is fundamental to the Player App. Your primary club, a participating club, or an authorized event organizer may, acting reasonably and in good faith, update, correct, or adjust your WPR or WPR-s where there is a significant discrepancy between your rating and your demonstrated level of play. This applies in particular to first-time players and to players whose ratings are based in whole or in part on self-assessment, including players in NC or LC status.

In connection with an event, tournament, or league, the organizer, a designated panel, or we may adjust your rating, division placement, eligibility, seeding, or handicap where you are materially under-rated or over-rated, to preserve competitive integrity. Adjustments may increase or decrease your rating or confidence level and take effect when applied. Where practicable, you will see the updated rating in your profile.

By using the Player App you acknowledge that your ratings may be adjusted as described in this Section. To the extent permitted by applicable law, neither we nor the clubs, coaches, or event organizers involved are liable for any loss, event placement, prize eligibility, or other consequence of an adjustment made in good faith. If you believe an adjustment is incorrect, your remedy is the appeal process in Section 3.7. Creating a duplicate account is not an acceptable way to dispute a rating.

3.7 Rating Appeals

If you believe your rating does not reflect your current level, or you dispute an adjustment made under Section 3.6, you may request a re-rating through the appeal process at https://app.worldpadelrating.com/re-rating or by contacting support@worldpadelrating.com. A human reviews every appeal. Our determination on an appeal is final for purposes of the rating system, and submitting an appeal does not suspend the current rating in the meantime. Nothing in this Section limits any right you have under applicable privacy law to obtain information about, or to contest, an automated decision.

3.8 Public Display

Your name, profile photograph, ratings, confidence level, match results, and tournament participation history are visible to other users and to the public on the Player App. Public display is a core feature, because the Player App exists to provide transparent player ratings and rankings. We may display and share your ratings in connection with the operation and promotion of the Player App. For a Minor Account, public display is described in, and consented to through, the parental consent form.

4. User Content and Feedback

You may submit content to the Player App, including profile information, photographs, match scores, and comments (“User Content”). You keep ownership of your User Content and grant us a non-exclusive, royalty-free, worldwide license to use, host, display, reproduce, and distribute it in connection with operating and promoting the Player App. This license ends when you delete your User Content or your account, except for content that has been incorporated into the public records of the Player App, such as match results and ratings, which we may retain in the form described in our Privacy Policy.

You are responsible for your User Content. We do not verify it, we are not obligated to back it up, and we may remove User Content that violates these Terms or our content standards, including comments that contain obscenities, another person’s personal information, or unlawful material.

Posting false or manipulated match scores is a serious violation. It may result in immediate suspension, permanent removal from the Player App, and a ban from WPR-sanctioned events.

If you send us ideas, suggestions, or proposals (“Feedback”), you agree that we may use them without restriction or compensation, that we owe no confidentiality obligation for Feedback, and that we may already be developing something similar.

5. Prohibited Conduct

You agree not to:

• Create multiple accounts or impersonate another person.
• Submit false information, including match scores, self-assessments, or personal details.
• Attempt to manipulate the rating system.
• Use the Player App for any unlawful purpose.
• Interfere with or disrupt the operation of the Player App, including by probing or testing the vulnerability of any system, circumventing security or authentication measures, or accessing non-public areas of the Player App.
• Access, scrape, or collect data from the Player App by automated means except through our public programming interface in accordance with its terms and Section 9 (Restrictions on Automated Access and Proprietary Data).
• Harass, threaten, stalk, or abuse other users, or solicit personal information from minors.
• Post unlawful, infringing, defamatory, obscene, hateful, or otherwise objectionable material, or unsolicited advertising.

6. Tournaments, Events, and Payments

6.1 Event Registration

When you register for an event, you agree to the rules and format of that event, to share your registration information with the club director or tournament organizer running it, and to accept match results as recorded by the organizer, subject to Section 3.7.

6.2 Sharing of Contact Information With Coaches, Clubs, and Organizers

When you request a verified rating from an authorized coach, club, or event organizer, or register for an event that requires one, your name and contact information, including your email address and telephone number, are made available to that coach, club, or organizer so they can carry out the rating or run the event. Coaches, clubs, and organizers who receive your information through the platform are required to use it only for that purpose and to keep it confidential, as described in our Privacy Policy. Except as described in these Terms and our Privacy Policy, we do not disclose your email address or telephone number to third parties for their own purposes.

6.3 Payments

Payments are processed by Stripe, Inc., and we do not store your payment credentials. Prices are subject to change until you confirm a purchase. Refund policies for events are set by the club directors and tournament organizers, not by us. Where subscription fees apply, they are billed on a recurring basis until you cancel. You are responsible for any taxes that apply to your purchases, except for taxes based on our income.

6.4 Find a Game and Partner Features

Where available, you may opt in to invite other players to practice games or organized play, or be matched with other players through the Player App or through third-party applications that use our public programming interface. You take part in any such game at your own risk, and we are not responsible for the conduct of other players or for any loss arising from a match arranged through these features, to the extent permitted by applicable law.

7. Event Photography, Image, and Likeness

7.1 Event Coverage

Events managed, organized, sanctioned, or powered by WPR, including events run by clubs, tournament directors, or organizers using WPR Manager (together, “WPR Events”), may be photographed, filmed, recorded, streamed, or broadcast, including match play, warm-ups, ceremonies, and general event footage. By registering for, participating in, or attending a WPR Event, you acknowledge that you may appear incidentally in event coverage, such as crowd shots, wide-angle court footage, results graphics, and live broadcasts, and that we, the host club, and the event organizer may use that coverage to document, report on, and broadcast the event.

7.2 Featured Promotional Use

Where we, the host club, or an event organizer wish to feature you individually in marketing or promotional content, such as a profile piece, an advertisement, or a promotional social-media post in which you are identifiable, we will ask for your consent at event registration or before the use, and you may decline or later withdraw that consent without affecting your ability to take part in the event. Where you give consent, you grant us, the host club, and the event organizer a worldwide, royalty-free license to use your name, image, likeness, voice, biographical information, ratings, and match results captured at or in connection with the WPR Event in the media and for the period described at the point of consent, without further compensation.

7.3 Minors

For a participant under 18, the parent or legal guardian who consented to the minor’s use of the Player App or registered the minor for the WPR Event gives the acknowledgment in Section 7.1 on the minor’s behalf, and any consent to featured promotional use under Section 7.2 must be given by the parent or legal guardian through the parental consent form or at event registration.

7.4 Questions and Requests

Questions about event coverage, and requests to withdraw consent or to remove content, may be sent to the tournament director of the applicable WPR Event and to support@worldpadelrating.com. Applicable privacy law may give you additional rights in relation to your image, which are described in our Privacy Policy.

8. Public Programming Interface

We offer a public programming interface (API) that authorized third-party applications, such as club-management and court-booking systems, may use to access publicly visible information and to link an existing WPR account. Use of the API is subject to separate API terms. The API cannot be used to create an account for a user under 13. Access to the Player App and its data by automated means is permitted only through the API and in accordance with those terms. Further restrictions on automated access appear in Section 9.

9. Intellectual Property

All intellectual property rights in the Player App, including the rating method, software, design, logos, and trademarks, are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Player App for your personal, non-commercial purposes, subject to these Terms. We reserve all rights not expressly granted. Third-party names, logos, and trademarks that appear in the Player App belong to their owners, who are not affiliated with us and do not sponsor the Player App.

10. Restrictions on Automated Access and Proprietary Data

10.1 Prohibition of Automated Access

You may not use any automated tool, bot, scraper, crawler, spider, script, or other automated means to access, collect, extract, copy, index, or monitor any part of the Player App or its content, except through our public programming interface in accordance with its terms or as we expressly authorize in writing.

This prohibition applies regardless of the technical method used, including HTTP requests, headless browsers, browser extensions that extract data in bulk, and any use of artificial intelligence or machine-learning systems to systematically collect or reproduce data from the Player App.

10.2 Protected Outputs and Compilation

World Padel Rating claims proprietary rights in the outputs generated by the Player App and in the Player App’s compilation of data as a whole, including the selection, arrangement, and presentation of that data and any database in which it is stored. The protected outputs and compilation include:

• Player ratings and confidence levels, including historical rating data.
• Match results, scores, and statistical outputs.
• Rankings and leaderboards, including their composition, ordering, and presentation.
• Event data, including tournament brackets, draws, schedules, registrations, and results.
• Player profile records as compiled and arranged by the Player App, including the organization of names, photographs, club affiliations, and biographical information into the Player App’s database.
• Any derivative data, aggregation, or compilation produced by the Player App from the above.

The proprietary rights claimed in this Section attach to the Player App’s generated outputs and to its compilation and arrangement of data. They do not extend to the underlying personal data of any individual player, and they do not affect your ownership of the content you submit under Section 4. Our collection and use of personal data, and your rights in your own personal information, including your right to data portability, are governed by our Privacy Policy.

10.3 Reverse Engineering the Rating Method

You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive, reconstruct, or approximate the logic, methodology, weights, parameters, or formulas used in our proprietary rating method or confidence scoring system, including by systematically analyzing Player App outputs to infer how the rating method behaves.

10.4 Permitted Use

Nothing in this Section restricts:

• Your ordinary use of the Player App through its interface to view profiles, ratings, results, and events.
• Access to publicly visible information through our public programming interface in accordance with its terms.
• Your exercise of data-portability or access rights under applicable privacy law.
• Access or use that we expressly authorize in writing.
• Search-engine indexing that complies with the directives in our robots.txt file.

10.5 Enforcement, Liquidated Damages, and Other Remedies

You acknowledge that a violation of this Section causes World Padel Rating harm that is real but difficult to quantify at the time you agree to these Terms, including loss of competitive advantage, diminished value of its proprietary outputs and compilation, degradation of the integrity of the rating system, and the costs of detecting, investigating, and remediating unauthorized access.

Because that harm is difficult to ascertain, you agree that for each incident of automated access, collection, or extraction in violation of this Section you will pay World Padel Rating liquidated damages of $7,500, as a reasonable pre-estimate of the harm described above and not as a penalty. For this purpose, an incident means a distinct scraping session, crawl, or extraction campaign, counted without regard to the number of individual records accessed within it. The liquidated damages payable under this Section will not exceed $250,000 in total.

These liquidated damages are payable in lieu of actual compensatory damages for the breach of this Section. They do not limit our right to seek injunctive or other equitable relief, to recover the costs of enforcement and reasonable attorneys’ fees, or to suspend or terminate your account.

11. Federations and Third-Party Services

11.1 USA Padel Registration

The Player App is operated in partnership with USA Padel (formerly known as the United States Padel Association or USPA), the national governing body for padel in the United States. Creating an account on the Player App includes registration of your player profile with USA Padel, which is required for participation in the rating system and in sanctioned events. Your profile and results are shared with USA Padel as described in our Privacy Policy, and USA Padel uses them under its own privacy policy. Registration with USA Padel is integral to the Player App and cannot be separated from account creation. For a Minor Account, the parental consent form describes this registration, and a parent who does not wish to register a child with USA Padel should not create the Minor Account.

11.2 Other Federations and Tournated

The Player App also works with other padel federations, including the Pan American Padel Confederation (PAC) and the International Padel Federation (FIP), and with the Tournated platform, through which federation-sanctioned events are administered. When you take part in federation-sanctioned events, your profile and tournament data may be shared with the relevant federation as described in our Privacy Policy. Nationality and gender are collected because federation rules require them for rankings, points, and event entry.

11.3 Third-Party Services

The Player App relies on third-party services such as Stripe. We are not responsible for the content, policies, or practices of third parties or of websites linked from the Player App, and your interactions with third parties, including any purchases, are between you and them.

12. App Store Terms

If you download the Player App from a third-party app store or distribution platform, such as the Apple App Store or Google Play, your use is also subject to that platform’s terms. You acquire the Player App as a license, not a sale. Where required by the platform, the platform provider is a third-party beneficiary of these Terms and may enforce them against you, and the platform provider is not responsible for the Player App or for providing support for it.

13. Assumption of Risk

Padel is a physical activity. Playing padel and taking part in events involve inherent risks, including the risk of physical injury. To the extent you use the Player App to register for or take part in events, including games arranged through the features in Section 6.4, you understand and voluntarily assume these inherent risks. For a Minor Account, the parent or legal guardian who provides consent acknowledges these risks on the minor’s behalf. Nothing in this Section limits any liability that cannot be limited under applicable law.

14. Disclaimer of Warranties

THE PLAYER APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLAYER APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RATING IS ACCURATE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE PLAYER APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE PLAYER APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the limitations in this Section may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for our gross negligence or willful misconduct, or for personal injury where the law does not permit its limitation.

16. Release

To the maximum extent permitted by law, and subject to the limits below, you release us and our officers, directors, employees, and agents from claims, demands, and damages arising out of your participation in events and your use of the Player App. This release does not apply to liability arising from our gross negligence or willful misconduct, to our breach of our data-protection obligations, or to any liability that cannot be released under applicable law. For a Minor Account, the parent or legal guardian who provides consent gives this release on the minor’s behalf to the extent the law allows.

17. Indemnification

You agree to indemnify and hold harmless us and our officers, directors, employees, and agents from claims, damages, losses, and expenses, including reasonable legal fees, arising from your violation of these Terms, your use of the Player App, or false information you submit. For a Minor Account, this obligation rests with the parent or legal guardian who provides consent.

18. Suspension and Termination

18.1 By You

You may delete your account at any time through the Player App or by contacting support@worldpadelrating.com. On deletion, we remove or replace the information that identifies you in your account, your profile is no longer searchable or displayed, and your match history is preserved in the public record of the Player App attributed to “WPR Player,” as described in our Privacy Policy. Deletion cannot be reversed. As described in Section 1.3, we retain your email address and telephone number for up to 30 days after deletion so that we can detect re-registration within that period, after which they are permanently destroyed.

18.2 By Us

We may suspend or terminate your account if you violate these Terms, create duplicate accounts, post false match results, or where we are required to do so by law. We will give you notice where practicable. Sections that by their nature should survive termination, including Sections 1.3, 4, 9, 10, 14, 15, 16, 17, and 22, survive.

19. Changes to the Player App

We may change, suspend, or discontinue any part of the Player App at any time. We will give notice of material changes where practicable.

20. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the “Last Updated” date and notify you by email or through a notice in the Player App at least 30 days before the changes take effect, unless a change must take effect sooner to comply with law. Your continued use after the changes take effect means you accept them.

21. Copyright Complaints

We respect the intellectual property rights of others and respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. 512. If you believe content on the Player App infringes your copyright, send a notice containing the information required by 17 U.S.C. 512(c)(3) to our designated agent: Copyright Agent, UP PADEL CORP d/b/a World Padel Rating, 580 North Sea Mecox Road, Southampton, NY 11968, United States; telephone 647-787-5821; email dmca@worldpadelrating.com. We may remove allegedly infringing content, notify the user who posted it, and terminate the accounts of repeat infringers.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms or the Player App is subject to the exclusive jurisdiction of the state and federal courts located in Suffolk County, New York, and you and we consent to the personal jurisdiction of those courts. Disputes are resolved through the courts; these Terms do not provide for arbitration. Nothing in this Section affects any non-waivable right you may have to bring a claim in your country of residence under local law.

23. Miscellaneous

These Terms, together with our Privacy Policy and, for a Minor Account, the parental consent form, are the entire agreement between you and us about the Player App. If any provision is found unenforceable, the rest remain in full force, and the unenforceable provision is enforced to the greatest extent permitted by law. We may assign these Terms; you may not assign them without our consent. Our failure to enforce a provision is not a waiver of it. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. We may give you notices by email or through the Player App. Headings are for convenience only. Only you and we may enforce these Terms; one user may not enforce them against another.
